1. Agreement to these terms

These terms of use ("terms") are a legally binding agreement between you and SellFaster ("we", "us", "our"), operated at sellfaster.ai, a UK-based service. By accessing or using SellFaster in any way, you agree to be bound by them. If you do not agree to all of them, do not use the service.

How you accept

You accept these terms by:

• Visiting sellfaster.ai
• Uploading photographs or entering a description
• Using any feature we provide
• Continuing to use the service after we post a change to these terms

Changes to these terms

We may change these terms at any time. When we do:

• We update the "last updated" date at the top of this page
• For material changes, we give reasonable notice on the website or by other means
• Continuing to use the service after a change takes effect is acceptance of it

If you do not agree to a change, stop using SellFaster.

2. What the service is

SellFaster is a web application that generates eBay listing content from photographs and basic item information you provide. We may add, change or remove features at any time; material changes will be announced on the website.

No guarantee of availability

The service is provided on an "as available" basis. We do not guarantee that:

• It will be uninterrupted, timely, secure or error-free
• Results will be accurate, reliable or complete
• The quality will meet your expectations
• Defects will be corrected

What you need

• A modern web browser with JavaScript enabled
• An internet connection
• The ability to upload image files
• Nothing to install

3. Eligibility

You must be at least 18 years old to use SellFaster. By using it you confirm that you are.

If you use it on behalf of a business or organisation, you confirm you have authority to bind that organisation to these terms.

4. Acceptable use

SellFaster is for generating listing content for items you intend to sell on eBay or a similar marketplace. Use it only for lawful purposes and in line with these terms.

What you must not do

Illegal content. Do not upload, process or generate content that:

• Breaks any local, national or international law
• Infringes anyone else's intellectual property
• Relates to counterfeit, stolen or illegally obtained items
• Involves prohibited items such as weapons, drugs or human remains

Harmful or offensive content. Do not create listings involving:

• Hate speech, harassment or discriminatory content
• Sexually explicit material
• Violence, gore, or content glorifying harm
• Fraudulent, deceptive or misleading information

Copyright and trademark infringement. Do not upload photographs of, or list:

• Copyrighted material you have no right to sell
• Counterfeit or replica goods
• Brand names or trademarks you are not authorised to use

Abuse of the service. Do not:

• Breach eBay's terms of service or policies
• Send spam or mass unsolicited communications
• Use bots, scripts or scrapers without our permission
• Reverse engineer, decompile or extract our source code
• Work around rate limits or usage restrictions
• Interfere with or disrupt the service or its servers

Misrepresentation. Do not use the service to:

• Generate false or misleading product descriptions
• Misrepresent an item's condition, authenticity or characteristics
• Create deceptive listings intended to defraud buyers

eBay compliance is yours

SellFaster generates content for eBay listings, but you are solely responsible for making sure a listing complies with eBay's user agreement and policies, with its prohibited and restricted items rules, and with the law. We do not check whether an item is permitted on eBay or anywhere else.

If you breach this section

Breaching this acceptable use policy may result in:

• Immediate termination of your access
• Deletion of content and generated listings
• Legal action where appropriate
• A report to the relevant authorities or platforms

5. Intellectual property

Ours

SellFaster and its contents, features and functionality - software, code, design, text, graphics, logos and the compilation of them - are owned by SellFaster and protected by copyright, trademark and other intellectual property laws.

You may not:

• Copy, modify, distribute or create derivative works from the service
• Use our trademarks, logos or branding without written permission
• Frame or mirror any part of the service
• Remove or alter copyright notices or proprietary markings

Your licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to use SellFaster for its intended purpose in line with these terms.

Yours

Your uploads. You keep all ownership of the photographs, images and descriptions you upload.

The licence you give us. By uploading content you grant us a limited, non-exclusive, royalty-free licence to process it through our AI service, to transmit and display it temporarily as needed to deliver the service, and to use anonymised, aggregated data to improve the service. That licence ends when the content leaves our systems, which for photographs and descriptions is immediately after processing.

The generated listing

All text, descriptions, titles and other content the AI produces from your input ("generated content") passes to you on creation. You may use, modify, publish and commercialise it without restriction, in your eBay listings or anywhere else.

No guarantee of uniqueness. Generated content is created for you, but similar inputs can produce similar outputs. We do not guarantee that yours is unique or that nobody else will receive something like it.

6. Your content and responsibilities

You are solely responsible for:

• Accuracy. That the photographs, descriptions and information you provide are accurate and truthful.
• Legal compliance. That the items you list comply with the law, with regulations and with platform policies.
• Condition. That you represent an item's condition, authenticity and characteristics accurately.
• Rights. That you hold the rights, licences and permissions needed for what you upload.
• The final listing. That you have reviewed, edited and approved the generated content before using it.

Review before you publish

This one matters. You must read and edit AI-generated content before using it in an eBay listing or anywhere else. It is a suggestion and a starting point. You are responsible for checking that descriptions are accurate and complete, correcting errors or anything inappropriate, customising the content to your actual item, and meeting eBay's listing requirements.

Nothing is posted for you. SellFaster does not publish listings to eBay or any other platform. What goes live is entirely your decision.

Content you must not upload

• Photographs of people without their consent
• Content that breaches someone else's privacy rights
• Explicit, violent or illegal imagery
• Content containing malware, viruses or harmful code
• Copyrighted images you have no right to use

7. AI output disclaimers

SellFaster uses artificial intelligence to generate listing content. You accept that:

• AI has limits. It can produce inaccurate, incomplete or inappropriate content.
• Accuracy is not guaranteed. That applies to descriptions, titles, pricing suggestions and everything else it generates.
• It can be wrong about the item. It may misidentify a brand, model, condition or characteristic.
• It is not professional advice. Generated content is not legal, tax, financial or expert advice.

You are solely responsible for reviewing, verifying and editing generated content before you use it. Do not rely on it without checking it. Providing it is not an endorsement of its accuracy, quality or suitability for your purposes.

8. Pricing and payment

SellFaster is currently free. There is no payment, subscription or financial obligation.

We may introduce paid features or subscription tiers in future. If we do, we will give reasonable advance notice and updated terms before anything is charged.

We may offer voluntary contribution options. These are entirely optional and do not affect your access to the service.

9. Changes and availability

We may:

• Modify, update or discontinue any part of the service at any time
• Add or remove features without notice
• Change the AI models or processing methods we use
• Change the interface, design or functionality

The service may be temporarily unavailable because of:

• Scheduled maintenance
• Technical or server problems
• Third-party outages, including AI providers
• Events outside our control

We are not liable for any loss, damage or inconvenience caused by interruptions or unavailability.

10. Disclaimers and warranties

SellFaster is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.

To the fullest extent the law permits, we disclaim all warranties, including as to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy - that generated content is accurate, complete or error-free
• Reliability - that the service will be uninterrupted, secure or timely
• Results - that a listing will sell or meet your expectations

SellFaster does not provide legal, tax, financial or professional advice. We rely on third-party services and cannot guarantee their availability, accuracy or performance.

11. Limitation of liability

To the maximum extent the law permits, SellFaster is not liable for any:

• Indirect, incidental, special, consequential or punitive damages
• Loss of profits, revenue, data or business opportunity
• Damages arising from an eBay account suspension or a listing being removed
• Damages arising from reliance on AI-generated content
• Damages arising from interruptions or unavailability

In no event shall our total liability to you for any claim arising from or related to SellFaster exceed £50 (fifty pounds sterling).

You acknowledge that these limits are a fundamental part of the agreement between us, and that we would not provide the service without them.

12. Indemnity

You agree to indemnify, defend and hold harmless SellFaster and its officers, directors, employees and agents against any claims, liabilities, damages, losses and expenses (including legal fees) arising from:

• Your use of SellFaster
• Content you upload or generate
• Your eBay listings or selling activity
• Your breach of these terms
• Your breach of anyone else's rights
• Your breach of the law

We may take exclusive control of the defence of any matter subject to indemnity, and you agree to cooperate with it.

13. Termination

You may stop using SellFaster whenever you like. There is nothing to cancel, because there is nothing to sign up for.

We may suspend or end your access immediately, without notice, if:

• You breach these terms
• We reasonably believe you are engaged in fraudulent or illegal activity
• Your use poses a security risk to us or to others
• The law requires it
• We discontinue the service

On termination, your right to use the service ends immediately. You keep ownership of content already generated, and any provisions that should survive termination do.

14. Disputes

Before starting formal proceedings, please contact us at legal@sellfaster.ai. We will try to resolve the matter informally within 30 days.

If that fails, either of us may propose mediation with a mutually agreed mediator before going to court. If informal resolution and mediation both fail, the dispute may be resolved through the courts named in the next section.

15. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising from these terms or your use of SellFaster.

If you are a consumer in the United Kingdom or the European Union, you may have statutory rights that cannot be waived. Nothing in these terms affects them.

16. General provisions

• Entire agreement. These terms and the privacy policy are the whole agreement between you and SellFaster about your use of the service.
• Severability. If any provision is found invalid or unenforceable, the rest continue in full force.
• Waiver. Not enforcing a right or provision is not a waiver of it.
• Assignment. You may not assign or transfer these terms without our written consent. We may assign our rights and obligations without restriction.
• Feedback. If you send us feedback, suggestions or ideas, you grant us an unlimited, irrevocable, perpetual, royalty-free licence to use, modify and incorporate them without compensation or attribution.
